QDHosts provides web hosting, domain registration, SSL certificates, website builder, reseller hosting, phone systems, and related services. The specific services you purchase are governed by these Terms along with any applicable service-level agreements or product-specific terms provided at the time of purchase.
2. Account Registration
To use our services, you must create an account and provide accurate, complete, and current information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorized use of your account
- Ensuring that your account information remains accurate and up to date
You must be at least 18 years of age to create an account and use our services.
3. Acceptable Use
You agree to use our services only for lawful purposes and in accordance with these Terms. You agree not to use our services to:
- Host, transmit, or store illegal content, including content that infringes on intellectual property rights
- Send unsolicited commercial email (spam) or engage in any form of bulk, unsolicited messaging
- Distribute malware, viruses, or other harmful code
- Conduct unauthorized network scanning, port scanning, or hacking activities
- Host phishing sites or pages designed to collect personal information fraudulently
- Engage in activities that disrupt or interfere with our network or servers
- Mine cryptocurrency or engage in resource-intensive non-web activities
- Resell or redistribute our services without our explicit written permission (except through our official reseller program)
We reserve the right to suspend or terminate any account that violates this Acceptable Use Policy without notice.
4. Payment and Billing
By providing payment information, you authorize us to charge the applicable fees for the services you select. All fees are listed in U.S. dollars unless otherwise stated.
- Billing Cycle: Services are billed monthly or annually depending on your selected plan.
- Auto-Renewal: Services automatically renew at the end of each billing period unless cancelled before the renewal date.
- Price Changes: We may change pricing with at least 30 days' written notice. Continued use after the notice period constitutes acceptance of the new pricing.
- Late Payment: Services may be suspended for non-payment after a 7-day grace period following the due date.
- Taxes: You are responsible for all applicable taxes, duties, and fees.
5. Refund Policy
We offer a 30-day money-back guarantee on new hosting accounts, on both monthly and annual plans.
Domain registrations, SSL certificates, and add-on services are non-refundable once activated. Refunds are not available for accounts terminated due to Terms of Service violations.
6. Uptime and Service Levels
We strive to maintain 99.9% uptime for all shared and reseller hosting plans. This guarantee excludes:
- Scheduled maintenance windows (announced in advance)
- Outages caused by third parties (including upstream network providers)
- Outages resulting from your own actions or code
- Force majeure events (natural disasters, civil unrest, etc.)
In the event of downtime exceeding our SLA, customers may request service credits as their sole remedy. Credits will not exceed the monthly service fee for the affected period.
7. Data and Backups
While we perform daily backups as part of most service plans, you are ultimately responsible for maintaining your own independent backups of your website data, databases, and email. QDHosts is not liable for data loss in the event that backups fail or are unavailable.
8. Intellectual Property
You retain ownership of all content you upload to our servers. By using our services, you grant QDHosts a limited, non-exclusive license to store, transmit, and display your content solely as necessary to provide the services.
Our website, logo, brand name, and service names are the intellectual property of Quadjam Enterprises Inc. You may not use our trademarks without our prior written consent.
9. Limitation of Liability
To the maximum extent permitted by law, QDHosts and Quadjam Enterprises Inc. shall not be liable for:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Unauthorized access to or alteration of your data
- Damages resulting from third-party actions
In no event shall our total liability to you exceed the total amount paid by you for the service in the twelve (12) months prior to the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless QDHosts, Quadjam Enterprises Inc., and their officers, directors, employees, and agents from any claims, liabilities, damages, or expenses (including reasonable attorney's fees) arising from your use of our services or your violation of these Terms.
11. Termination
Either party may terminate services at any time:
- By you: Cancel your account through the client portal or by contacting our support team. Cancellations take effect at the end of the current billing period.
- By us: We may suspend or terminate your account immediately for Terms violations. We may also terminate services with 30 days' written notice for any other reason.
Upon termination, your data will be retained for 30 days before permanent deletion. It is your responsibility to export your data before termination.
12. Governing Law
These Terms shall be governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Montgomery County, Pennsylvania.
13. Changes to These Terms
We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice of material changes via email or a notice on our website. Your continued use of our services after the effective date of any changes constitutes your acceptance of the new Terms.
